Consumer sale (purchase of a consumer from an entrepreneur)
In a situation where the goods received by the Buyer have a defect and it becomes apparent within 2 years of delivery, the Buyer has the right to demand a price reduction or withdraw from the contract, unless immediately and without undue inconvenience to the Buyer replace the defective item for a non-defective one or that you remove the defect (this limitation does not apply if the item has already been replaced or repaired). A claim for removal of a defect or replacement of a sold item for one free of defects expires after one year from the date of finding the defect. It should also be remembered that the limitation period cannot end before the expiry of two years (in practice, this means that the consumer may have up to 3 years to report the defect). It is important that within 12 months of delivery, you have the obligation to prove that the defect was caused by the fault of the Buyer.
Specify the place and method of submitting a complaint in your regulations. You are required to respond within 14 days. If you do not do this, it is assumed that the complaint was considered reasonable by you.
When returning an item as part of a complaint, the Buyer should properly secure it. This does not mean having to send it back in its original packaging. The buyer does not have to attach a receipt to the parcel.
By accepting his claims, you also reimburse any costs that the buyer has incurred. However, if you reject them, you should send the goods back to him - he has the opportunity to assert his case in court.

Non-consumer sales
The difference compared to consumer sales is that although a claim for removal of a defect or replacement of an item free from defects also expires after a year (counting from the date of finding the defect), the limitation period may end within two years. In case of doubt, the Buyer will have to prove that he used the item for its intended purpose.
