Does the possibility of complaint about a defective product apply to all types of transactions (bidding and buy now)?
Yes. However, the buyer cannot complain about the goods based on a specific defect if it was disclosed in the transaction description .
Am I obliged to provide a guarantee for the goods sold?
No. The guarantee is not compulsory - you give it voluntarily. The warranty conditions are strictly defined by the guarantor.
The warranty does not exclude, limit or suspend the Buyer's rights arising from the warranty .
Can the Buyer withdraw from the contract only for new items?
Not only. The Buyer (consumer) is also entitled to withdraw from the contract in the case of second-hand, exhibition, presentation, discounted and promotional goods.
Can I reserve on the item page that I do not accept returns?
No. Such information may violate applicable law.
Does the buyer have to send back the goods that were originally packed?
There is no statutory obligation to return goods in their original packaging. The item should be sent back in a package that prevents its damage.
You may refuse to accept a return if it applies to music and movie discs and computer software media delivered in a sealed package, if the package was opened after delivery.
Does the Buyer have to inform in writing that he wants to withdraw from the contract and return the goods?
The regulations do not specify the form in which the statement on withdrawal from the contract is to be submitted. The declaration must be submitted within 14 days of receipt of the item.
Does the Buyer have to attach a receipt to the returned goods?
There is no such obligation. However, due to the necessity of documenting the return by the Seller, it is worth placing it in the returned parcel.
Can I collect the amount I have set for the return?
No. The seller may not demand payment for withdrawal from the contract (so-called transfer fee). Even if such a provision is in the contract (for example, in the store regulations), it is invalid.
Who covers the shipping costs in the event of withdrawal and return of the goods?
The buyer covers the cost of returning the item, unless you have agreed to pay or have not informed him of the need to bear these costs. However, you return funds using the same method of payment that the Buyer used, and if you chose a method of delivery other than the cheapest method of delivery available in the offer, you are not obliged to refund the additional costs incurred to the Buyer.
Who covers the shipping costs in the event of a complaint?
If you accept the complaint arising from the warranty, you cover the shipping costs. If the Buyer has paid for sending the goods back to you, he should reimburse him all the costs incurred.
